Employers in New York are required to carry workers' compensation insurance for all employees. There are exceptions in narrow circumstances.

Penalties are harsh and pitiless. Some statutory penalties for failure to have workers' compensation insurance were doubled in 2008. Those doubled penalties are independent of other penalties and reimbursement on claims filed by injured workers. Even more daunting, the sole proprietor, partners or officers of a corporation are personally liable for a business' failure to secure workers' compensation insurance.

The laws are complex, and call for experienced representation. The biggest challenge is often just getting the WCB bureaucracy to see employers as real people, not just numbers.
